TERMS AND CONDITIONS OF SUPPLY

1.1  What these termscover. These are the termsand conditionson which we supply products to you.

1.2  Why you should read them. Please read these termscarefully before you submit your order to us. These termstell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these termsor require any changes, please contact us to discuss.

 

  1. INFORMATION ABOUT US AND HOW TO CONTACT US

 

2.1  Who we are. We are The Beef Man Ltd. a company registered in England and Wales. Our company registration number is 11821893 and our registered office is at 21 Grand Union Crescent, London, E8 4TR.

2.2  How to contact us. You can contact us by telephoning our customer service team at 07402517193 or by writing to us at info@thebeefman.com.

 

2.3  How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order.

 

2.4  ”Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes emails.

 

  1. OUR CONTRACT WITH YOU

 

3.1  How we will accept your order. Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us.

3.2  If we cannot accept your order. If we are unable to accept your order, we will inform you of this in writing to the email you provided when you placed it.

 

3.3  Your order number. We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order.

 

3.4  We only sell to the UK. Momentarily, our website is solely for the promotion of our products in the London Area 1. Unfortunately, we do not accept orders from outside that area at the moment. Nevertheless, if you are outside of London or in a zone not mentioned above, feel free to contact us to our email in order to check availability. We will keep you informed when we are able to sell our products in other areas.

 

  1. OUR PRODUCTS

 

4.1  Products may vary slightly from their pictures. The images of the products on our website are for illustrative purposes only. Your product may vary slightly from those images.

4.2  Availability. The products are subject to availability and market conditions. We will do our best to update accordingly our website. Nevertheless, it could happen that we are not able to update it while you are placing an order. In the unlikely event that we are un unable to deliver an item you have ordered, we may contact you and offer a reasonable substitute. You may reject that substitute, and you will not be charged for it, or, if you have paid already, we will refund any amount paid for it. If we do not offer a substitute, we will remove the Product from your order so that you are not charged or, if you have paid already, we will refund you the price. We will, however, bear no liability for unavailability of Products.

4.3 Weight of the Products.Our products are priced by weight. We show the prices for weights on the Website. The weight you receive may slightly vary but, in any case, the weight of the product you receive will match or exceed the weight set on the weight. You will be charged for the set weight, even if the actual weight of your product exceeds this.

4.3We sell only to end users and our Products are not for re-sale. You warrant that you shall not re-sell any of the Products.

  1. PROVIDING THE PRODUCTS

 

5.1 Delivery processing time.All orders are processed during business days and Saturdays. Orders are not shipped or delivered on Sundays or public holidays. If we are experiencing a high volume of orders, shipments may be delayed by a few hours. If there will be a significant delay in shipment of your order, we will contact you via email or telephone.

 

5.2  When we will provide the products. During the order process we will let you know the available time slots and dates when we can provide the products to you. 

 

5.3  Delivery costs. The costs of delivery will be as displayed to you on our website and they will depend on special offers and the delivery address.Delivery charges for your order will be calculated and displayed at checkout based on the product and the total value of the order.

5.4 Shipment confirmation & Order tracking. You will receive a Shipment Confirmation email once your order has shipped containing your tracking number(s). The tracking number will be active within 24 hours.

 

5.5Damages during delivery.We are not liable for any products damaged or lost during shipping. If you received your order damaged, please contact the shipment carrier to file a claim.Please save all packaging materials and damaged goods before filing a claim.

 

5.6  We are not responsible for delays outside our control. If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received. Due to the nature of the Products, if there is no person at the designated delivery address to receive the goods and no further instructions where given when placing the order, we will not be able to leave the products. Please, bear in mind that the fleet waiting tolerance is five minutes.  

 

5.7  Collection by you. If you have asked to collect the products from our premises, you can collect them from us at any time during our working hours of 9am to 6pm on weekdays (excluding public holidays) and Saturdays.

 

  1. YOUR RIGHTS TO END THE CONTRACT

 

6.1  Cancelling the order because of something we have done or are going to do. If you are cancelling an order for a reason set out below the contract will end immediately and we will refund you in full for any products which have not been provided and you may also be entitled to compensation. The reasons are:

(a)  we have told you about an error in the price or description of the product you have ordered and you do not wish to proceed;

(b)  there is a risk that supply of the products may be significantly delayed because of events outside our control.

 

6.2  Exercising your right to change your mind (Consumer Contracts Regulations 2013). For most products bought online you have a legal right to change your mind within 14 days and receive a refund. Unfortunately, due to the nature of our business and the laws governing fresh food, we are unable to accept returns. Should you have a problem with your delivery you can contact us at07402517193 or by writing at info@thebeefman.com. If you are unhappy with the specifications of a product you have received, please take images of the product and include these in an email to us. We can use these to investigate the issue thoroughly.If for exceptional circumstances a refund is authorised the refund will be made onto either the credit / debit card the order was placed on or a credit will be processed onto the credit account if one exists with us. No cash refund will be made.

 

6.3  How long do I have to change my mind?Since we work with next day deliveries, cancellations or amendments to orders can be made within 1 hour of placing your order. In case you chose another date that is not next day delivery, you can cancel or amend your order 24 hours before the delivery date. In order to avoid any doubt, please send an email cancelling or amending your order.  

 

6.4  When your refund will be made. We will make any refunds due to you as soon as possible. If you are exercising your right to change your mind then your refund will be made within 14 days.If you haven’t received a refund yet, first check your bank account again. Then contact your credit or debit card company, it may take some time before your refund is officially posted. Next contact your bank. There is often some processing time before a refund is posted. If you’ve done all of this and you still have not received your refund yet, please contact us at info@thebeefman.com.

 

6.5 If there is a problem with a product. If you have any questions or complaints about the product, please contact us.

  1. PRICE AND PAYMENT

 

7.1  Where to find the price for the product. The price of the product (which includes VAT at 0%) will be the price indicated on the order pages when you placed your order. We use our best efforts to ensure that the price of the product advised to you is correct. However please see below for what happens if we discover an error in the price of the product you order.

7.2 On changes in the rate of VAT. If the rate of VAT changes between your order date and the date we supply the product, we will adjust the rate of VAT that you pay, unless you have already paid for the product in full before the change in the rate of VAT takes effect.

 

7.3  What happens if we got the price wrong. It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the product’s correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the product’s correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and cancel the order.

 

7.4  When you must pay and how you must pay. We acceptpayment withVisa, MasterCard, Amex, Paypal, Apple Pay, Google Pay, Shopify Pay, Maestro. You will be charged when your order is placed.. You must pay for the products before we dispatch them. We will charge your credit or debit card when the order is placed. 

 

7.5  What to do if you think an invoice is wrong. If you think an invoice is wrong please contact us promptly to let us know. You will not have to pay any interest until the dispute is resolved. Once the dispute is resolved we will charge you interest on correctly invoiced sums from the original due date.

 

  1. OTHER IMPORTANT TERMS

 

8.1  We may transfer this agreement to someone else. We may transfer our rights and obligations under these termsto another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.

8.2  If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these termsoperates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

 

8.3  Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under theseterms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the products, we can still require you to make the payment at a later date.

 

8.4  Which laws apply to this contract and where you may bring legal proceedings. These termsare governed by English law and you can bring legal proceedings in respect of the products in the English courts.
